1. Acceptance of Terms

By accessing or using LienFlash ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately stop using the Service. These Terms constitute a legally binding agreement between you and Domin8 Commerce LLC.

2. Description of Service

LienFlash is a technology platform that automates the generation, formatting, and USPS Certified Mail delivery of preliminary lien notices for construction industry professionals. The Service includes AI-powered document analysis, address verification, state-specific notice template generation, and mail tracking. LienFlash is NOT a law firm and does NOT provide legal advice.

3. User Responsibilities

Users are solely responsible for:

• The accuracy of all information provided, including project details, addresses, and amounts
• Verifying that the notices generated comply with their specific state's legal requirements
• Filing notices within applicable statutory deadlines
• Ensuring proper authorization to send notices on behalf of their company

LienFlash automates delivery of notices, not legal compliance. The responsibility for legal compliance rests entirely with the user.

6. Indemnification

You agree to indemnify, defend, and hold harmless Domin8 Commerce LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

7. Payment Terms

All payments are securely processed through Stripe. By purchasing a subscription or single notice, you authorize Domin8 Commerce LLC to charge the payment method on file. Subscriptions automatically renew at the end of each billing period unless canceled. You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period.

8. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, software, notice templates, and AI models, are the exclusive property of Domin8 Commerce LLC and are protected by copyright, trademark, and other intellectual property laws.

9. Account Termination

Domin8 Commerce LLC reserves the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to use the Service will immediately cease.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state and federal courts located in Miami-Dade County, Florida.

11. Modifications

Domin8 Commerce LLC reserves the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the Service after any modifications constitutes your acceptance of the updated Terms.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
